TERMS

These Terms govern your use of expresscart.net, the Express Cart e-commerce platform, and our iOS and Android mobile applications (collectively, the “Service”). By creating an account or accessing or using the Service, you agree to be bound by these Terms.

Your account

• You must be at least 18 and able to enter a binding contract.
• Give accurate information and keep it up to date.
• Keep your password safe. You are responsible for all activity under your account.
• Tell us immediately at support@expresscart.net if you suspect unauthorised access.

Using the Service

Express Cart lets merchants create online stores, list products, accept payments and manage orders. Each merchant is the seller of their own products and is responsible for:

• Product descriptions, prices, stock, taxes and invoices.
• Shipping, delivery, returns, refunds and customer service.
• Following all applicable laws, including consumer protection, e-commerce and tax laws.
• Their own store policies (privacy, returns, shipping) shown to their customers.

Prohibited use

You may not use the Service to:

• Sell illegal, counterfeit, stolen or restricted goods.
• Infringe anyone's intellectual property or privacy.
• Send spam, or upload malware or harmful code.
• Attempt to hack, overload or interfere with the Service or other stores.
• Mislead or defraud customers.

We may suspend or remove stores that break these rules.

Plans, fees and payments

• Plan prices and features are listed on our Pricing page.
• Fees are billed in advance and are non-refundable unless the law requires otherwise or we state otherwise.
• Payment gateway charges (Razorpay, Stripe, PayPal) are set by those providers and are separate from our fees.
• We may change prices with prior notice; changes apply from your next billing period.

Payments to merchants

Customer payments are processed by the payment gateway the merchant connects, under that gateway's terms. Express Cart does not hold merchant funds and is not responsible for gateway decisions such as holds or chargebacks.

Your content

You own the content you upload (logo, products, images, text). You give us permission to host and display it only to provide the Service. You confirm you have the rights to everything you upload.

Our intellectual property

The Express Cart name, logo, software, themes and apps belong to [COMPANY LEGAL NAME]. You may not copy, modify or resell them except as the Service allows.

Availability

We work to keep the Service available, but it may sometimes be interrupted for maintenance, updates or reasons beyond our control. We may add, change or remove features.

Termination

You can close your account at any time. We may suspend or end your access if you break these Terms or if required by law. After closure, you can request an export of your store data within 30 days.

Disclaimer and limitation of liability

The Service is provided "as is". To the extent permitted by law, Express Cart is not liable for indirect or consequential losses, lost profits or lost data. Our total liability is limited to the fees you paid us in the 12 months before the claim.

Indemnity

You agree to compensate Express Cart for claims arising from your store, your products or your breach of these Terms.

Governing law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or the use of the Service shall be subject to the applicable laws and legal procedures of India.

Changes to these Terms

We may update these Terms. We will change the "Last updated" date and notify merchants of significant changes. Continuing to use the Service means you accept the updated Terms.
